Today, the Supreme Court has decided that in the case of ASDA supermarket chain, the lower paid shop floor staff (who by and large and generally women) can use those employed in the warehouse (who are by and large generally men) as comparators. This is an important decision in the ongoing equal pay claim. The Court has stressed, this does not mean that the 44,000 claimants currently making the claim have won their case.
